Cinematix Creator Agreement
Version 1.1 · Published October 23, 2026
This Creator Agreement (this "Agreement") is between the following parties. It takes effect for you on the date you accept it in your Cinematix account (your "Effective Date").
(a) Cinematix, Inc., a Delaware corporation, of 131 Continental Dr, Suite 305, Newark, DE 19713, United States ("Cinematix", "we", "us"); and
(b) the person or company who accepts this Agreement through their Cinematix account, identified by the name, email address, and payout details on that account (the "Creator", "you").
Together the "Parties", and each a "Party".
If you accept this Agreement for a company or a team, you confirm that you have the authority to bind them, and "you" means that company or team.
1. Purpose
1.1 Cinematix runs cinematixtv.com, a place where independent filmmakers, many of whom use AI tools, show their work to their fans, and where fans can support them directly.
1.2 This Agreement explains what happens when you publish a Film on Cinematix: who owns it, what Cinematix may do with it, how fan support is shared, and how you get paid.
1.3 This Agreement does not require you to upload anything. You can publish one Film, many Films, or none. You can publish an episode now and turn it into a series later.
In short (this box is a summary to help you read. The numbered sections below are the binding terms.)
- You own your film. Cinematix never takes your copyright.
- Non-exclusive. Post the same film anywhere else. Enter any festival.
- Free to upload. You pay nothing to publish or keep your film here.
- Cinematix takes 10%. Stripe's payment fee is deducted. The rest is yours.
- Remove your film anytime. Money you already earned stays yours. A balance under the payout minimum ($20 in most countries) is lost if you close your account.
2. Definitions
2.1 "Film" means any video work you publish on Cinematix: a single short film, a feature, a series, an episode of a series, or a trailer, in any length or aspect ratio. It includes a "Coming Soon" page that shows a poster and trailer before the Film is released.
2.2 "Fan Support" means money a fan sends to you through Cinematix, either as a one-time payment or as a Monthly Subscription.
2.3 "Monthly Subscription" means a recurring monthly payment by a fan for access to your channel. Where available, you choose the monthly price from $5, $10, or $15.
2.4 "Supporter-only Content" means a Film, or part of a Film, that you choose to make available only to fans with an active Monthly Subscription. You can set a whole Film as supporter-only, or make the first episodes free and the rest supporter-only. Fans without a subscription see the poster, description, and trailer, and are shown how to subscribe when they press play.
2.5 "Coin Unlock" means the optional feature where fans pay with Coins to watch an episode. It is off unless you turn it on.
2.6 "Promotional Materials" means thumbnails, posters, previews, short clips, stills, and excerpts that Cinematix makes from your Film to promote it. A trailer you upload yourself is part of your Film, not Promotional Materials.
2.7 "Terms of Service" means the Cinematix Terms of Service at cinematixtv.com/legal/terms, as updated from time to time.
2.8 "Effective Date" means the date you accept this Agreement.
3. Your Film Is Yours
3.1 You keep 100% of the copyright and all other rights in your Film. Cinematix does not own any part of it and will never claim to.
3.2 Cinematix will not sell your Film, license it to another company, or give it to anyone else, except as described in Section 5 (promotion).
3.3 You must be 18 years old or older to publish as a Creator.
3.4 When you publish a Film, you confirm that:
(a) you made the Film, or you have permission from everyone who holds rights in it, including co-creators, actors, and composers, and you have followed the license terms of any AI tool you used to make it;
(b) the Film does not copy anyone else's work without permission;
(c) if a real, identifiable person appears in the Film (their face, voice, or likeness, including AI-generated versions), you have their consent;
(d) the Film follows the content rules in the Terms of Service (Sections 4 and 8). In short: no sexual content, no content that harms or sexualizes minors, no hate, no deepfakes of real people without consent, no content that breaks the law.
3.5 Your responsibility. You are responsible for your Film and for what you do on Cinematix. If someone makes a claim against Cinematix because: (a) something you confirmed in Section 3.4 was not true, (b) you broke this Agreement or the Terms of Service, or (c) you broke the law or someone else's rights, you agree to cover the costs that result, including reasonable legal fees. You are not responsible for any claim that does not result from (a), (b) or (c). This includes claims that turn out to have no basis and claims that happen because Cinematix broke this Agreement or the law. Terms of Service Section 6.9 has the details.
4. Non-Exclusive
4.1 This Agreement is non-exclusive. You can publish the same Film on YouTube, Instagram, X, Vimeo, TikTok, or any other platform, at the same time, for free or for money. There is no exclusive period and no waiting period.
4.2 You can enter your Film in any film festival or competition.
4.3 You can edit, unpublish, or delete your Film at any time from your studio page. You do not need our permission.
4.4 Cinematix is also free to work with other creators and to promote other Films.
5. Permission to Host and Promote
5.1 To run the service and help your Film find fans, you give Cinematix permission to:
(a) host, store, convert, stream, and display your Film on Cinematix;
(b) make Promotional Materials from your Film. This can include light editing for promotion only, such as cropping, resizing, adding captions or subtitles, and choosing which scenes to show;
(c) show your Film and the Promotional Materials on Cinematix (including the featured section on the home page), on our social media accounts, in our Discord community, in newsletters, and in other marketing for Cinematix, with your name or channel name credited wherever the format allows.
5.2 This permission is worldwide, non-exclusive, and royalty-free. It does not give Cinematix ownership of your Film. Cinematix will not sell your Film or license it to anyone else.
5.3 No AI training. Cinematix will never use your Film, or any part of it, to train AI models, and will not allow anyone else to do so through Cinematix.
5.4 If you delete your Film, Cinematix stops streaming it. Promotional Materials that Cinematix already published before you deleted the Film (for example, a social media post from last month) may stay up, but Cinematix will not make new ones. Cinematix may keep backup copies for up to 90 days, or longer only if the law requires it.
6. Free to Publish, Free to Watch by Default
6.1 Publishing on Cinematix costs you nothing. There are no upload fees, hosting fees, or monthly fees.
6.2 By default, every Film you publish is free for anyone to watch.
6.3 You can choose to limit access in two ways. Both are optional and off unless you turn them on:
(a) Supporter-only Content (where available): make a whole Film, or episodes after a point you choose, available only to fans with a Monthly Subscription. See Section 10.
(b) Coin Unlock: ask fans to pay with Coins to watch an episode. See Section 7.4.
6.4 You can switch a Film between free and supporter-only at any time. See Section 10.5.
7. Fan Support and Fees
7.1 What Fan Support is. Fan Support is money from your fans to you. Cinematix collects it, keeps a fee, and passes the rest to you. It is not a payment from Cinematix for your Film, and it is not a license fee or royalty.
7.2 How each payment is split. For every one-time payment or Monthly Subscription payment:
(a) Tax. If the fan's country requires sales tax or VAT, it is added on top of the support amount and paid by the fan. Tax is not part of your earnings, and Cinematix's 10% is not charged on it.
(b) Cinematix fee. Cinematix keeps 10% of the support amount (before tax).
(c) Payment processing fee. The payment company (Stripe) charges a fee on the full amount the fan pays, including any tax. You pay this fee. It is currently about 2.9% + $0.30 per payment, plus about 1.5% for cards issued outside the United States, plus small fixed amounts for fraud screening and, for subscriptions, recurring billing (currently $0.05 and 0.7%). Stripe may change these rates.
(d) Your share. Everything that is left is yours.
7.3 Payout transfer fee and currency. When Cinematix sends your monthly payout to your bank, Stripe charges a transfer fee (currently $0.25 per payout, plus 0.25% or more for accounts outside the United States, depending on the country). You pay this fee once per payout. Cinematix pays Stripe's monthly account fee for your payout account; you do not. Payouts are made in US dollars. If your bank account is in another currency, your bank or Stripe converts the amount at their exchange rate and may charge a conversion fee. Cinematix does not control or add to that fee.
7.4 Coin Unlock. If you turn on Coin Unlock, you receive 70% of the Coin price of each unlock. Payment processing fees for Coin purchases are covered inside Cinematix's 30%; you do not pay them separately. If you live outside the US, US tax may be withheld from your coin earnings where US law requires it. See Section 9.6.
7.5 Side by side.
| Fan Support (one-time and monthly) | Coin Unlock | |
|---|---|---|
| Cinematix fee | 10% of the support amount, before tax | 30% of the Coin price |
| Payment processing fee | Paid by you (about 3% + $0.30, more for international cards and subscriptions) | Included in Cinematix's 30% |
| Payout transfer fee | $0.25 per monthly payout, paid by you. One fee covers both Fan Support and Coin earnings paid out together | Same payout, same single fee |
| Your share | Typically around 80%, a little lower for small or international payments | 70% |
7.6 Examples. A fan in the United States supports you with $5. Stripe's processing fee is about $0.45. Cinematix keeps $0.50. About $4.05 is added to your balance (81%). A fan in another country supports you with $5. Stripe's fee is about $0.57. Cinematix keeps $0.50. About $3.93 is added (79%). At the end of the month, one $0.25 transfer fee is taken from your total payout. Over many payments, you can expect to keep around 80% of what fans give, a little lower for small payments and payments from outside the United States, because Stripe's fixed fee is a larger share of a small payment.
7.7 Changing the rates. If Cinematix changes its 10% fee or the 70% Coin share, Cinematix will publish a new version of this Agreement and ask you to accept it. Support you earned before you accept the new version is paid under the old rates. See Section 13.
8. Refunds and Chargebacks
8.1 Sometimes a fan gets their money back: Cinematix issues a refund, or the fan's bank reverses the payment (a "chargeback"). When that happens for a payment made on or after the Effective Date, that payment is removed from your earnings too.
8.2 Only that payment. Only the earnings from the refunded or reversed payment are affected. Earnings from other payments, from the same fan or from other fans, are not touched.
8.3 How it works.
(a) If the payment is still in the 14-day holding period, that part of your pending balance is cancelled.
(b) If the money was already paid out to you, the amount is deducted from your future earnings. Cinematix does not take money back from your bank account.
(c) If your unpaid balance is not enough to cover the deduction, your balance goes below zero.
8.4 If your balance goes below zero. Cinematix never asks you to return money we have already sent, and never takes money from your bank account. Instead, your balance stays below zero until new earnings bring it back to the payout minimum in Section 9.3. Payouts pause automatically when this happens. Cinematix reviews the account and tells you the result within 5 business days; if the account is in good standing, payouts resume with the next monthly cycle once your balance reaches the payout minimum. If you later win a chargeback dispute, the reversed amount is restored to your balance.
8.5 Payments made before the Effective Date are not affected by this Section. If one of them is refunded or reversed, Cinematix covers the cost.
8.6 Cinematix may suspend or close accounts that abuse refunds or chargebacks.
9. Getting Paid
9.1 How. Payouts go through Stripe Connect to your bank account. You set up your Stripe account from your studio page. Stripe requires you to be 18 or older and to verify your identity. If Stripe restricts or pauses your account (for example, because identity verification is incomplete), payouts pause until that is resolved with Stripe. Your balance is kept and is paid once the account is active again.
9.2 When. Once a month, on the first business day of the month. A business day is a weekday that is not a US Federal Reserve holiday. Each fan payment is held for 14 days after the fan pays, then becomes available for the next monthly payout. This means a payment can take about 2 to 7 weeks to reach you, depending on when in the month the fan paid.
9.3 Minimum. At least $20. For some countries Stripe sets a higher minimum for payouts (for example, South Korea); your studio page shows the minimum for your country. If your available balance is below the minimum, it rolls over to the next month. It keeps rolling over for as long as your account is open. See Section 12.4 for what happens to a balance below the minimum when you close your account.
9.4 First payout and reviews. Before your first payout, Cinematix reviews your account and your tax form. After that, payouts run automatically each month. Cinematix may hold a payout for review if activity looks unusual (for example, a sudden spike in support far above your normal level, or a pattern that looks like fraud). If that happens, Cinematix tells you within 5 business days what is being checked and what happens next.
9.5 Tax forms. Before you can be paid, you must give your tax information. If you are a US person, you give your US tax ID (SSN or EIN) during Stripe account setup, and this serves as your Form W-9. If you are outside the US, you fill in Form W-8BEN (W-8BEN-E for a company) inside your Cinematix studio. This tells the US tax office who you are and where you live. Without a form, payouts stay on hold. A W-8BEN expires after three years, and Cinematix will remind you before it does.
9.6 US withholding tax (creators outside the US). If US law requires Cinematix to withhold US tax from money you earn here, Cinematix will tell you before it does so and will withhold only the amount the law requires. Whether anything is withheld, and how much, depends on the type of earnings, US law, the tax treaty between your country and the US, and the information you give on Form W-8BEN. Any amount withheld is shown on your Payouts page, and Cinematix gives you the yearly tax statement the law requires.
9.7 Your taxes. You are responsible for any taxes you owe in your own country on money you earn here. If a law requires Cinematix to collect more information from you, Cinematix will tell you first.
9.8 If Stripe does not support your country. Cinematix will contact you and arrange a manual payout. The same fees, timing, and minimum apply.
9.9 Records. Your studio page shows each payment, the fees taken, and your balance.
10. Monthly Subscriptions (where available)
10.1 This Section applies once Monthly Subscriptions and Supporter-only Content are available on your channel. Cinematix will tell you when they are.
10.2 Fan cancels. A fan can cancel at any time. They keep access until the end of the period they paid for, and the subscription does not renew. The payment they already made stays in your earnings.
10.3 You remove some content. If you unpublish or delete some of your Supporter-only Content, existing subscriptions continue and no refund is owed. Keep in mind that a fan who feels they did not get what they paid for may still ask their bank for a chargeback. If that happens, Section 8 applies and the chargeback is deducted from your earnings.
10.4 You turn subscriptions off, remove your supporter content, or close your channel. If you turn off subscriptions for your channel:
(a) new subscriptions stop immediately;
(b) existing subscriptions do not renew. Each subscriber keeps access until the end of the period they already paid for, and no refund is owed;
(c) you must keep your Supporter-only Content available until the last of those paid periods ends.
(d) If you remove all your Supporter-only Content while subscribers still have paid time left, their subscriptions end immediately and each subscriber receives a refund for the unused part of their current billing period. Those refunds, with their payment fees, are deducted from your balance under Section 8. Before you remove the content, your studio page shows you the estimated refund total;
(e) if the estimated refund total is more than your available balance, you cannot remove all your Supporter-only Content yourself. Contact Cinematix at support@cinematixtv.com and we will work out the timing with you.
(f) If you close your channel, your Films are taken off public view, existing subscriptions end immediately, and each subscriber receives a refund for the unused part of their current billing period. Those refunds, with their payment fees, are deducted from your balance under Section 8.
10.5 Switching content between free and supporter-only. You can do this at any time. Making supporter-only content free does not entitle existing subscribers to a refund.
10.6 Changing your subscription price. You can change your monthly price at any time. New subscribers pay the new price right away. For existing subscribers: a lower price applies from their next billing date. A higher price applies from their first billing date that is at least 14 days after Cinematix emails them about the change. A subscriber who cancels before that date keeps access at the old price until their paid period ends. You can raise the price for the same subscriber at most once every 30 days.
11. Relationship
11.1 You are an independent creator. Nothing in this Agreement makes you an employee, agent, partner, or joint venturer of Cinematix, and you cannot make commitments on Cinematix's behalf.
11.2 Cinematix runs the platform where you publish your Films. It collects payments from fans and pays out your share as described in this Agreement. Cinematix is not a buyer, distributor, or publisher of your Film.
12. Term and Ending This Agreement
12.1 This Agreement starts on the Effective Date and continues until either Party ends it.
12.2 You can leave at any time by deleting your Films or closing your account. No notice period is required.
12.3 Cinematix can suspend or end this Agreement if you break this Agreement or the Terms of Service, if required by law, or in the case of fraud. If that happens:
(a) Cinematix tells you in writing what the reason is and which rule was broken;
(b) you can reply within 14 days with your explanation or a fix (for example, removing a Film that broke a rule). Cinematix reviews your reply and answers within 10 business days. If you do not reply within 14 days, Cinematix decides based on the information it has;
(c) while the review is open, your Films may stay unpublished and payouts may be held, but your balance is kept;
(d) if the review ends in your favor, your Films and payouts are restored. If not, this Agreement ends and Section 12.4 applies.
12.4 Your earnings when this Agreement ends. When this Agreement ends, for any reason, Cinematix still pays you the Fan Support and Coin Unlock earnings you earned before that date, on the normal monthly schedule, after the normal 14-day holding period. If your final balance is at or above the payout minimum in Section 9.3, it is paid in full. If it is below that minimum, it cannot be paid out and is forfeited; before you close your account, your studio page shows your balance so you can wait until it reaches the minimum if you prefer. If your account is closed and a balance at or above the minimum still has not been paid out 6 months after closing (for example, because no payout account is connected), Cinematix reviews it and may either cancel that balance or keep it open for another 6 months. The only other exception is earnings connected to fraud, illegal activity, or abuse of refunds and chargebacks. Only the earnings connected to that activity are withheld. The rest of your balance is still paid.
12.5 If your balance is below zero when this Agreement ends, Cinematix absorbs the shortfall. You owe nothing.
12.6 Sections 3.4, 3.5, 5.4, 8, 9.6, 9.7, 12.4, 12.5, 14, and 15 continue to apply after this Agreement ends.
13. Changes
13.1 If Cinematix changes the fees, the revenue split, or any other term of this Agreement, Cinematix will publish a new version with a new version number and ask you to accept it in your account.
13.2 The new version applies to you only after you accept it. Until then, this version continues to apply. Fan Support you earned before you accept the new version is paid under this version.
13.3 If you do not accept the new version, you can keep your Films published under this version for as long as Cinematix supports it, or you can leave under Section 12.2. Cinematix will give you at least 7 days before any feature that depends on the new version is required.
14. Governing Law and Disputes
14.1 This Agreement is governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
14.2 If there is a disagreement, the Parties will first try to resolve it by discussing it in writing. Either Party can start that by writing to the other (Cinematix at support@cinematixtv.com).
14.3 If that does not resolve it, the state and federal courts in Delaware have exclusive jurisdiction, except where the law of the country where you live gives you protection that cannot be taken away by agreement.
15. General
15.1 Terms of Service. The Terms of Service also apply to you. If this Agreement and the Terms of Service say different things about the same topic, this Agreement wins for that topic. The sections of the Terms of Service on liability, warranties, indemnity, and general terms (the sections on Creator responsibility and indemnity, Limitation of Liability, Disclaimer of Warranty, and Miscellaneous) apply to this Agreement as if written here.
15.2 Entire agreement. This Agreement, together with the Terms of Service, is the whole agreement between you and Cinematix about publishing Films on Cinematix. It replaces any earlier messages or conversations about these topics, including any earlier revenue share figures you may have been told.
15.3 If part of this Agreement is invalid, the rest still applies, and the invalid part is replaced by a valid one that comes as close as possible to its purpose.
15.4 Assignment. You cannot transfer this Agreement to someone else. Cinematix may transfer it to a company that takes over the Cinematix service, and will tell you if that happens.
15.5 No waiver. If either Party does not enforce a right under this Agreement, that does not mean the right is given up.
15.6 Language. This Agreement is written in English. If Cinematix provides a translation, the English version governs if they differ.
